 About Parking Enforcement

The Bylaw Department is responsible for the enforcement of the Town of Newmarket's parking bylaws. It consists of four staff that enforces the Parking Bylaw. Some of the most common parking issues are the 3 hour parking limit on all streets, winter parking, impeding a sidewalk, parking in a handicapped space and parking in fire routes.

  • Parking Enforcement is committed to the delivery of professional by-law enforcement in a timely and effective manner and in accordance with council direction.

Parking Enforcement

Parking Enforcement is responsible for enforcing standards pertaining to parking on public road allowances and as requested on private property. Enforcement of parking regulations supports improved road safety, traffic flow, accessibility, and assists the town in managing its road infrastructure for street cleaning, refuse removal and snow clearing.

Complaint Process

Parking complaints may be registered by phone, e-mail, in person or by online self-service in writing. The town keeps the identity of every complainant confidential unless the complainant has agreed to be identified.  Complaints will be accepted only if the following information is provided:

  • Complainant name, address and telephone number
  • Complaint location (address)
  • A satisfactory explanation of the complaint and details that would assist.

How does The Town of Newmarket respond to parking complaints?

The town's Parking Officers will investigate your complaint as soon as possible.  Upon receipt of the infraction, our Parking officers will be notified and will respond as soon as they become available.

To report a parking complaint, please call The Town of Newmarket's Customer Service department at 905-895-5193 or by email or file your complaint online via our Access Newmarket Self-Serve.  If after hours, please leave a message and a customer service associate will process your request.

PARKING REGULATIONS AND ENFORCEMENT
The following is an overview of the common parking regulations and related information for the Town of Newmarket.  


Year Round Parking Regulations

    1. No vehicle is permitted to park for more than 3 consecutive hours on any street in Newmarket except between the hours of 7:00pm and 11:00pm unless otherwise posted.
    2. Vehicles are not permitted to park on Town streets between the hours of 2:00 am and 6:00 am from November 1st through to April 15th.
    3. Vehicles are not permitted to park on or over sidewalks, or over boulevards located between the sidewalk and roadway, including driveway ramps.
    4. No person is permitted to park a vehicle on private property without the consent of the owner or occupant of the property.
    5. Vehicles are not permitted to park within 10 feet of a fire hydrant.
    6. Parking in prohibited areas, facing the wrong direction is not permitted on any Town street.
    7. Parking of trucks in excess of 2,500 kg (2.7 tonnes) on any residential street is not permitted.
    8. Parking or stopping in designated fire routes is not permitted.
    9. No person may park a vehicle in a space designated for disabled persons without displaying a valid disabled person's permit.

Winter Parking Regulations

Residents are reminded that as of November 1, it is strictly prohibited to park a vehicle on any roadway:

    1. That interferes with the clearing of snow between the hours of 2:00 a.m. and 6:00 a.m. from November 1 to April 15
    2. for more than three consecutive hours except between 7:00 p.m. and 11:00 p.m.
    3. in front of, or within two feet of a driveway or laneway 

Any motor vehicle found on the roadway between the hours of 2:00 a.m. and 6:00 a.m. from November 1 to April 15 may be subject to a fine of $75.00 under the Town of Newmarket Parking By-law 1993-62 section 10(I).

Parking Exemptions

Exemptions may be granted for driveway repairs or vehicle breakdowns.

To obtain a parking exemption, call 905-895-5193 and provide the following information: NAME, ADDRESS, PHONE #, LICENCE PLATE #, MAKE OF VEHICLE AND LENGTH OF TIME exemption is required.

EXEMPTIONS ARE RESTRICTED DURING WINTER MONTHS beginning November 1st and continuing to April 15th, and become void if snow removal and or winter road maintenance operations become necessary.

Enforcement

Any vehicles found in contravention of the by-laws may be issued a ticket and /or towed away at the owner's expense. Parking violation fines vary from $20.00 to $300.00.

In the event that the fine is not paid within the time frame specified on the ticket, additional costs will be levied by the Ontario Court.

IN SUMMARY 

Parking regulations ensure that our streets are safe and clear to accommodate traffic flow, emergency vehicles and snowplows. The Anti-idling by-law helps to reduce air pollution.

Call the Town of Newmarket at 905-895-5193, to request an exemption, or to leave a complaint regarding vehicles parked illegally on Town streets. After hours, please leave a message including your contact information with our answering service. The officer will either respond to the complaint or return your call if you request an exemption. PLEASE NOTE: requests for parking exemptions received after hours are not valid unless the officer has approved the request.

How to Pay a Parking Fine

You can pay your fine by any of the following methods:

  • Online via the self serve payment feature. (Unless notice of fine increase has been received.)
  • In person (cash, cheque, debit or credit card) at the Town of Newmarket Municipal Offices, 395 Mulock Drive, Newmarket, ON L3Y 8P3 or
  • By phone (Mon - Fri 8:00 am - 5:00 pm) using your credit card or
  • Mail in payments (cheques only; no cash please) can be sent to this address or deposited in the drop-off box at the Main entrance, or

To Dispute a Parking Ticket

Every parking ticket comes with a 15-day deadline to either pay the fine or dispute the ticket. If you receive a parking ticket and wish to dispute it, you (or your representative) must appear in person at the First Attendance Facility, 395 Mulock Drive, Building & By-laws counter, any Thursday from 9:30am to 11:30am and 2:00pm to 4:00pm. After discussing the matter, you may choose to pay a reduced fine or request the trial option (forms will be completed to begin this process).

  • If you neither dispute the ticket nor pay the fine before the 15-day deadline, a Notice of Impending Conviction (NIC) will be sent to the registered owner of the vehicle. At this point you can still dispute your ticket or pay the fine.
  • If you do not respond by the due date on the NIC, a Notice of Fine and Due Date (NFDD) showing the set fine plus court costs will be sent to the registered owner of the vehicle. This will result in an automatic conviction that is registered with the Ministry of Transportation.
  • If the set fine including the additional court costs is not paid by the due date shown on the NFDD the offence becomes eligible for plate denial, the matter goes to the Ministry of Transportation and the Town has no further involvement.

Anti-Idling Efforts

 To reduce unnecessary vehicle emissions, air pollution and smog, the Town has implemented a by-law that limits vehicle idling to a maximum of two minutes. Idling is when the engine is running but the vehicle is not moving. After observing a vehicle idling for more than two minutes, a Town of Newmarket By-law Enforcement Officer may issue a ticket for $250.00.

 This by-law is concerned with controlling unnecessary idling, and does not restrict the practice when conditions require it; such as in cold weather or during heavy traffic situations.

It does not apply to vehicles involved in emergency activity or parades, or commercial vehicles that require idling as part of their operation, or idling as part of a vehicle repair.
