Zoning B​y-laws in Newmarket

Newmarket has several zoning by-laws which govern land use in Town. The majority of lands are governed by the Comprehensive Zoning By-law 2010-40​. Zoning By-law 2010-40 is applicable to all lands in Newmarket except for those lands noted on the Lands Excluded from Zoning By-law 2010-40 map. If the lands you are interested are excluded from Zoning By-law 2010-40, please contact contact the Planning Department for additional information.

​Zoning By-law Ame​ndments and Applications

The Official Plan outlines in a broad manner the land use and development guidelines in Newmarket. A Zoning By-law, on the other hand, outlines how a specific parcel of land may be used. Zoning By-laws also regulate lot size, parking requirements, building height and other site-specific factors.

If an applicant wishes to develop a property in a manner that deviates from the current zoning provisions, they must apply for a Zoning By-law Amendment; also referred to as a rezoning. For example, a change of use from residential to commercial would require a Zoning By-law Amendment. Council must approve any amendment to the Zoning By-law, which is subject to an appeal process.

Section 34 of the Ontario Planning Act gives the Council for the Town of Newmarket the authority to adopt zoning by-laws in conformity with its Official Plan. Zoning amendments provide a way to change zoning regulations for individual properties.
